These General Terms and Conditions govern your use of the Qovery platform. BIRDSIGHT SAS ("QOVERY") operates qovery.com and provides a platform to deploy applications on your own cloud provider accounts. By using the platform, you agree to these terms.

00Definitions

Service

The Qovery control plane, CLI, API, web console, Terraform provider, MCP server, and AI Skill - collectively, the tools that orchestrate deployments on your cloud infrastructure.

Customer

The legal entity or individual that registers an account on the Qovery platform and agrees to these terms.

User

A person or software agent (including AI agents) that accesses the platform through a Customer account.

Cloud Account

The customer-owned cloud provider account (AWS, GCP, Azure, Scaleway) where workloads are deployed.

Customer Content

All applications, data, configurations, and intellectual property that the Customer deploys through the platform. Qovery never accesses or processes Customer Content.

Subscription

The ongoing service agreement between Qovery and the Customer, governed by the selected plan (Free Trial, Team, Business, or Enterprise).

Purpose

BIRDSIGHT SAS, trading as "QOVERY", a French simplified joint-stock company registered under number 852 571 108, with headquarters at 128 rue de la Boetie, 75008 Paris, operates the website www.qovery.com and provides a platform that enables customers to deploy, manage, and observe applications on their own cloud provider accounts.

These General Terms and Conditions define the rights and obligations of the parties in connection with the provision and use of the Qovery platform and services.

QOVERY is a French SAS (Societe par Actions Simplifiee) registered with the Paris Trade and Companies Register under number 852 571 108. Headquarters: 128 rue de la Boetie, 75008 Paris, France. Contact: [email protected].

Contractual documents

The contractual relationship consists of: (1) any signed Quotation or Order Form, and (2) these General Terms and Conditions. In case of conflict, the Quotation or Order Form prevails. Quotations are valid for 30 days from issuance and must be accepted in writing.

Access to the platform

Access to the platform requires legal capacity. If registering on behalf of a legal entity, you represent that you have the authority to bind that entity to these terms. The platform is designed for both professional customers (businesses) and individual customers.

Acceptance of terms

By checking the acceptance box during registration, you confirm that you have read, understood, and accepted these General Terms and Conditions in full. Partial acceptance is not possible.

Registration and accounts

Registration requires authentication via a supported third-party provider (GitHub, GitLab, Bitbucket) and valid payment information for paid plans. All information provided must be accurate and kept up to date. Accounts are for personal use - you are responsible for maintaining the security of your credentials.

User accounts and AI agents

Customers can create User accounts up to the limit of their subscription plan. Users include both human operators and software agents (including AI coding agents). The Customer is responsible for all actions taken by its Users, whether human or automated.

The services

Qovery offers four subscription tiers: Free Trial, Team, Business, and Enterprise. Each tier includes a defined set of features, deployment minutes, managed clusters, and support levels. Qovery provides hosting infrastructure management with an obligation of means (not result). The platform includes corrective and evolutionary maintenance, with new releases notified in advance.

Term and cancellation

Subscriptions run for an unlimited duration unless specified otherwise in an Order Form. Customers may cancel at any time from their account settings. Upon cancellation, the account remains active for 14 days, after which it is deleted along with all associated data and configurations.

Fees and payment

Pricing is as specified on the platform or in a signed Quotation. Payment is by credit card or bank transfer with a 30-day payment period. Late payments may result in: suspension of services, forfeiture of payment terms, interest at 3x the legal rate, and a 40 EUR flat fee for recovery costs (for professional customers).

Customer obligations

Customers must: comply with all applicable laws and regulations, provide accurate and complete information, cooperate with Qovery support when requested, take responsibility for all content deployed through the platform, and not assign or transfer their account to third parties without written consent.

Liability and limitations

Qovery provides services with an obligation of means, not an obligation of result. Qovery does not guarantee that services will meet all customer requirements or be uninterrupted. Liability is limited to direct damages only. Total liability is capped at the fees paid by the customer in the 12 months preceding the claim. Claims must be submitted in writing within one month of the event.

Intellectual property

All intellectual property related to the Qovery platform, including software, documentation, and trademarks, is and remains the property of BIRDSIGHT SAS. The Customer retains full intellectual property over their applications, code, and data deployed through the platform.

Governing law and jurisdiction

These terms are governed by and construed in accordance with French law. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
